
After a protracted legal battle spanning five years, the High Court, presided over by Her Ladyship Justice Marie-Louise Simmonds, has discharged former Ghana Football Association President Kwesi Nyantakyi and his co-accused.
The trial, which garnered national attention, ended without the Republic calling a single witness.
The case faced significant hurdles, particularly in securing testimony from key witnesses. The final of five prosecution witnesses refused to testify unless allowed to wear a mask – an unusual request that further complicated proceedings.
With no substantial evidence presented, the court deemed it untenable to continue the case.
The Court of Appeal’s ruling on January 30, 2025, played a pivotal role in shaping the High Court’s decision, reinforcing the principle that a fair trial requires the prosecution to present credible evidence within a reasonable timeframe.
This case, which stemmed from an investigative expose by journalist Anas Aremeyaw Anas, affirms the importance of due process and the need for efficient case management within the judicial system.
