The Accra High Court dismissed an application by Emmanuel Felix Amantey, a lecturer, who sought to prevent COP Christian Tetteh Yohuno from serving as Deputy Inspector General of Police in charge of operations.
Amantey argued that creating this role exceeded the authority of the Police Council and the Presidency, as neither the Constitution nor the Ghana Police Service Act provides for a Deputy Inspector General specifically dedicated to operations.
Though the Police Service Regulations mention an office for operations, they do not designate a deputy position for it.
Amantey’s judicial review application accused the President and Police Council of acting unlawfully.
In his ruling, Justice Richard Apietu explained that the High Court’s supervisory jurisdiction was not applicable here because it pertains to decisions made by lower adjudicating bodies, which the President and Police Council are not.
He further noted that their actions were administrative rather than judicial, leading to the dismissal of the application.
